The Heller Foundation is a world-renowned non-profit, educational organization created in 2008 by the lead plaintiff, Dick Heller, immediately following the landmark precedent set forth in the magnificent District of Columbia v. Heller, 554 U.S. 570 (2008) United States Supreme Court decision. Heller was the very first United States Supreme Court case – in history- to determine whether the Second Amendment protects an individual right to keep and bear arms for self-defense or whether the ‘right’ was only intended to for state militias.
Associate Justice Antonin Scalia wrote the binding precedent on June 26, 2008, held (5-4), in affirming the earlier decision by the United States Court of Appeals for the District of Columbia Circuit, ruling that the Second Amendment protects an individual’s right to keep and bear arms- unconnected with service in a militia- for traditionally lawful purposes, such as self-defense within the home. Additionally, the majority opinion held that the District of Columbia’s handgun ban and requirement that lawfully-owned rifles and shotguns must be kept “unloaded and disassembled or bound by a trigger lock” violated this guarantee, enumerated in and protected by the Second Amendment to the United States Constitution.
